Par conséquent, les éventuelles limitations et conditions de ce droit n'empêchent pas que les dispositions de l'article 18, paragraphe 1, CE confèrent aux particuliers des droits qu'ils peuvent faire valoir en justice et que les juridictions nationales doivent sauvegarder (voir, en ce sens, arrêt du 4 décembre 1974, Van Duyn, 41/74, Rec. p. 1337, point 7).
