28 In dit verband zij eraan herinnerd dat richtlijn 2001/23 beoogt te verzekeren dat de werknemers bij een overgang van de onderneming hun rechten behouden en op dezelfde voorwaarden als zij met de vervreemder waren overeengekomen, in dienst van de nieuwe werkgever kunnen blijven (zie met name arresten van 10 februari 1988, Tellerup, „Daddy’s Dance Hall”, 324/86, Jurispr. blz. 739, punt 9, en 9 maart 2006, Werhof, C‐499/04, Jurispr. blz. 28 In that connection, it should be borne in mind that Directive 2001/23 is intended to safeguard the rights of employees in the event of a change of employer by allowing them to continue to work for the transferee employer on the same conditions as those agreed with the transferor (see, inter alia, Case 324/86 Tellerup (‘Daddy’s Dance Hall’) [1988] ECR 739, paragraph 9, and Case C‐499/04 Werhof [2006] ECR I-2397, paragraph 25).

The directive only prohibits such modifications from taking place on the occasion of and because of the transfer (see to that effect, in particular, Case 324/86 Foreningen af Arbejdsledere i Danmark, ‘Daddy’s Dance Hall’ [1988] ECR 739, paragraph 17; Case C‐209/91 Watson [1992] ECR I‐5755, paragraph 28, and Collino and Chiappero, paragraph 52).

25 In haar opmerkingen in zaak C-132/91 bracht de Commissie voorts nog naar voren, dat het Hof in zijn arrest van 10 februari 1988 (zaak 324/86, Daddy' s Dance Hall, Jurispr. 1988, blz. 739, r.o. 15) te kennen had gegeven, dat de door de richtlijn beoogde bescherming is onttrokken aan de beschikking van de partijen bij de arbeidsovereenkomst.
