41 Juist ter verbetering van deze reeds in punt 17 van het arrest Gerling e.a. genoemde bescherming van de begunstigde verzekerde, die economisch gezien in de zwakste positie verkeert, is overigens artikel 9, lid 1, sub b, van verordening (EG) nr. 44/2001 van de Raad van 22 december 2000 betreffende de rechterlijke bevoegdheid, de erkenning en de tenuitvoerlegging van beslissingen in burgerlijke en handelszaken (PB 2001, L 12, blz. 1) aldus geformuleerd dat het de verzekerde of de begunstigde van een verzekeringsovereenkomst uitdrukkelijk is toegestaan de verzekeraar op te roepen voor het gerecht van zijn eigen woonplaats, terwijl artikel 8, eerste alinea, punt 2, van het Executieverdrag slechts voorziet in de bevoegdheid van het gerecht van de woonplaats van de verzekeringnemer, maar niet bepaalt of de verzekeraar kan worden opgeroepen voor het gerecht van de woonplaats van de verzekerde of de begunstigde.
41 Moreover, it is for the purpose of strengthening that protection, already upheld in paragraph 17 of Gerling and Others, that Article 9(1)(b) of Council Regulation (EC) No 44/2001 of 22 December 2000 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (OJ 2001 L 12, p. 1) was drafted in such a way as expressly to enable insured or beneficiaries under an insurance contract to bring proceedings against the insurer before the courts of their own domicile, and the second indent of the first paragraph of Article 8 of the Brussels Convention provides only for jurisdiction of the courts of the policy-holder’s domicile, without determining whether or not the insurer may be sued before the courts of the domicile of the insured or of a beneficiary.

22 De Belgische medeverzekeraars en de regering van het Verenigd Koninkrijk verwijzen naar het arrest van 14 juli 1983, Gerling e.a. (201/82, Jurispr. blz. 2503), waarin het Hof voor recht heeft verklaard dat indien een verzekeringsovereenkomst tussen een verzekeraar en een verzekeringnemer, door laatstgenoemde gesloten voor zichzelf en ten behoeve van derden, een forumkeuzebeding bevat met betrekking tot eventueel door die derden aanhangig te maken geschillen, laatstgenoemden, ook al hebben zij het forumkeuzebeding niet uitdrukkelijk aanvaard, zich daarop kunnen beroepen indien aan het in artikel 17 van het Executieverdrag gestelde vereiste van schriftelijkheid is voldaan in de betrekkingen tussen verzekeraar en verzekeringnemer, en de verzekeraar duidelijk zijn instemming heeft betoond.
22 The Belgian co-insurers and the United Kingdom Government refer to the judgment in Case 201/82 Gerling and Others [1983] ECR 2503, in which the Court ruled that where a contract of insurance, entered into between an insurer and a policy‐holder and stipulated by the latter to be for his benefit and to ensure for the benefit of third parties to such a contract, contains a clause conferring jurisdiction relating to proceedings which might be brought by such third parties, the latter, even if they have not expressly signed the said clause, may rely upon it provided that, as between the insurer and the policy‐holder, the condition as to writing laid down by Article 17 of the Brussels Convention has been satisfied and provided that the consent of the insurer in that respect has been clearly manifested.
