Kan den i fråga 1 beskrivna nationella lagstiftningen om fasta bokpriser – vilken i sig strider mot artikel 28 EG, eventuellt även i egenskap av säljform som inkräktar på den fria rörligheten för varor och vars mål rent allmänt omskrivs i ett krav på hänsyn till böckernas särskilda ställning som kulturföremål, konsumenternas intresse av rimliga bokpriser och näringsbetingelserna för bokhandlarna – anses vara motiverad enligt artikel 30 EG eller artikel 151 EG, exempelvis med hänvisning till allmänintresset av att bokframställningen främjas, att det finns ett stort urval av boktitlar till reglerade priser och att det finns en mångfald i detaljistledet, trots att det saknas empiriska fakta som styrker att medlet i form av ett i lag föreskrivet fastställande av fasta bokpriser är ägnat att uppnå de därmed eftersträvade målen?
Is the national statutory obligation to sell books at the fixed price which, according to the first question, is per se incompatible with Article 28 EC – in any event on the basis that it constitutes selling arrangements which infringe free movement of goods – justified by reference to Article 30 EC or Article 151 EC, on the basis that its purpose is, very generally, described as the need to have regard to the status of books as cultural assets, to consumers’ interest in reasonable prices for books, and to the commercial characteristics of the book trade, for example having regard to a general interest in encouraging the production of books, a diversity of titles at regulated prices, and a diversity of bookshops, notwithstanding the lack of empirical data which could prove that a statutory obligation to sell books at the fixed price is a suitable means for achieving the intended purposes?EurLex-2 EurLex-2
