44 In its examination of that appeal, the Cour de cassation (Court of Cassation) has doubts, in particular, on whether the interpretation given by the Court of Justice in the judgment of 27 April 2017, A-Rosa Flussschiff (C‐620/15, EU:C:2017:309), which concerned a dispute where E 101 certificates had been issued under Article 14(2)(a) of Regulation No 1408/71, is also valid in a dispute relating to the offence of concealed employment and concerning certificates issued under Article 14(1)(a) of that regulation, with respect to workers carrying out their activity in the Member State of which they are nationals and on the territory of which the air transport undertaking that employs them has a branch, where a mere reading of those certificates permits the conclusion that they were fraudulently obtained or relied on.
44 En el marco del examen de dicho recurso de casación, el referido órgano jurisdiccional se pregunta, entre otras cosas, si la interpretación dada por el Tribunal de Justicia en la sentencia de 27 de abril de 2017, A-Rosa Flussschiff (C‐620/15, EU:C:2017:309), relativa a un litigio en el marco del cual se habían expedido certificados E 101 en virtud del artículo 14, punto 2, letra a), del Reglamento n.o 1408/71, se impone igualmente en el marco de un litigio relativo al delito de trabajo encubierto y que se refiere a certificados expedidos, en virtud del artículo 14, punto 1, letra a), de dicho Reglamento, respecto de trabajadores que ejercen su actividad en el Estado miembro del que son nacionales y en cuyo territorio la empresa de transporte aéreo que les emplea dispone de una sucursal, cuando la mera lectura de dichos certificados permite deducir que fueron obtenidos o invocados de manera fraudulenta.EuroParl2021 EuroParl2021
