In a recent decision, cited in this case by both the national court and the German Government, the Bundesverwaltungsgericht held that Article 12a GG constitutes lex specialis and, as such, is consistent with the principles of equal treatment and freedom to choose a profession laid down in the other abovementioned provisions of the Constitution (judgment of 30 January 1996 - 1 WB 89/95 - BVerwGE, volume 103, p. 301, and NJW, 1996, p. 2173; hereinafter `the Sanitätsdienst decision', relating to the medical service, which is one of the services to which women may also be recruited in accordance with Article 12a GG, Article 1(2) SG and Article 3a SLV).
Bundesverwaltungsgericht on äskettäisessä tuomiossaan, johon ennakkoratkaisupyynnön esittänyt tuomioistuin ja Saksan hallitus ovat nyt käsiteltävänä olevassa asiassa viitanneet, katsonut, että perustuslain 12 a § on sopusoinnussa edellä mainituissa muissa perustuslain säännöksissä ilmaistujen, tasa-arvoista kohtelua ja ammatin valitsemisen vapautta koskevien periaatteiden kanssa, koska se on pitänyt tätä säännöstä erityislakina (tuomio 30.1.1996 - 1 WB 89/95 - BVerwGE nro 103, s. 301 ja NJW, 1996, s. 2173; jäljempänä Sanitätsdienst-tuomio; tapauksessa oli kysymys terveydenhoitoalasta eli sellaisesta alasta, jolle myös naiset voivat päästä perustuslain 12 a §:n, SG:n 1 §:n 2 momentin ja SLV:n 3 a §:n mukaan).EurLex-2 EurLex-2
