WHEREAS IT HAS NOW BEEN ESTABLISHED THAT CONTAGIOUS PORCINE PARALYSIS ( TESCHEN DISEASE ) OCCURS ONLY IN IMST , INNSBRUCK ( STADT ), INNSBRUCK-LAND , KITZBUEHEL , KUFSTEIN , LANDECK , REUTTE AND SCHWAZ DISTRICTS ( BEZIRK ) OF BUNDESLAND TYROL , AUSTRIA , AND THAT VACCINATION AGAINST THAT DISEASE IS PERMITTED IN THOSE DISTRICTS ;
considerando che , ai sensi degli articoli 7 e 15 della direttiva , si prevede che le proibizioni di cui agli articoli 6 e 14 si applichino soltanto a una parte del territorio di un paese terzo ;

- da animali che hanno soggiornato in territorio austriaco , ad esclusione dei distretti di Imst , Innsbruck ( città ) , Innsbruck ( campagna ) , Kitzbuehel , Kufstein , Landeck , Reutte e Schwaz ( Bundesland del Tirolo ) , per almeno tre mesi prima della macellazione , ovvero dal momento della nascita , se trattasi di animali di età inferiore a tre mesi ;

WHEREAS THE CENTRAL VETERINARY AUTHORITIES OF AUSTRIA HAVE GIVEN SATISFACTORY ASSURANCES THAT SWINE WHICH HAVE BEEN AT ANY TIME IN IMST , INNSBRUCK ( STADT ) , INNSBRUCK-LAND , KITZBUEHEL , KUFSTEIN , LANDECK , REUTTE AND SCHWAZ DISTRICTS ( BEZIRK ) OF BUNDESLAND TYROL OR FRESH MEAT OF SUCH SWINE WILL NOT BE EXPORTED TO THE COMMUNITY ;
considerando che le autorità veterinarie responsabili austriache hanno assicurato in modo soddisfacente che i suini che si siano trovati in qualsiasi modo nei distretti di Imst , Innsbruck ( città ) , Innsbruck ( campagna ) , Kitzbuehel , Kufstein , Landeck , Reutte e Schwaz ( Bundesland del Tirolo ) o le carni fresche ottenute da detti suini non saranno esportati verso la Comunità ;

( B ) FRESH MEAT OF DOMESTIC ANIMALS OF THE PORCINE SPECIES EXCLUDING THAT ORIGINATING IN IMST , INNSBRUCK ( STADT ) , INNSBRUCK-LAND , KITZBUEHEL , KUFSTEIN , LANDECK , REUTTE AND SCHWAZ DISTRICTS ( BEZIRK ) OF BUNDESLAND TYROL , CONFORMING TO THE GUARANTEES LAID DOWN IN THE ANIMAL HEALTH CERTIFICATE IN ACCORDANCE WITH ANNEX B , WHICH MUST ACCOMPANY THE CONSIGNMENT ;
b ) carni fresche di animali domestici della specie suina , ad esclusione di quelle di suini provenienti dai distretti di Imst , Innsbruck ( città ) , Innsbruck ( campagna ) , Kitsbuehel , Kufstein , Landeck , Reutte e Schwaz ( Bundesland del Tirolo ) , che posseggano i requisiti indicati nel certificato dipolizia sanitaria che deve accompagnare la merce , redatto in conformità dell ' allegato B ;

Whereas the responsible veterinary authorities of Austria have confirmed that the Imst, Innsbruck (Stadt), Innsbruck-Land, Kitzbuehel, Kufstein, Landeck, Reutte and Schwaz districts (Bezirk) of Bundesland Tyrol have for at least 12 months been free from contagious porcine paralysis (Teschen disease) and that no vaccinations have been carried out against that disease during that time in the districts mentioned above;
considerando che le autorità veterinarie responsabili dell'Austria hanno confermato che i distretti (Bezirke) di Imst, Innsbruck città, Innsbruck campagna, Kitzbuehel, Kufstein, Landeck, Reutte e Schwaz nel Bundesland Tyrol sono stati per almeno 12 mesi esenti da paralisi contagiosa dei suini (morbo di Teschen) e che nello stesso periodo non è stata effettuata in tali distretti alcuna vaccinazione contro detta malattia;

WHEREAS , HOWEVER , A PARTICULAR PROBLEM WAS IDENTIFIED CONCERNING THE OCCURRENCE OF AND VACCINATION AGAINST CONTAGIOUS PORCINE PARALYSIS ( TESCHEN DISEASE ) IN IMST , INNSBRUCK ( STADT ) , INNSBRUCK-LAND , KITZBUEHEL , KUFSTEIN , LANDECK , REUTTE AND SCHWAZ DISTRICTS ( BEZIRK ) OF BUNDESLAND TYROL , NECESSITATING THE EXCLUSION OF THOSE DISTRICTS FROM TRADE IN SWINE AND MEAT OF SWINE TO THE COMMUNITY ; WHEREAS COMMISSION DECISION 80/1298/EEC ( 3 ) , AS AMENDED BY DECISION 81/316/EEC ( 4 ) , HAS ESTABLISHED HEALTH PROTECTION MEASURES IN RESPECT OF BUNDESLAND TYROL ;
considerando , tuttavia , che un problema particolare è stato identificato a proposito della presenza della paralisi contagiosa dei suini ( malattia di Teschen ) e della vaccinazione contro la suddetta malattia nei distretti di Imst , Innsbruck ( città ) , Innsbruck ( campagna ) , Kitzbuehel , Kufstein , Landeck , Reutte e Schwaz ( Bundesland del Tirolo ) , per cui è necessario escludere questi distretti dall ' esportazione di suini e di carni suine verso la Comunità ; che con decisione 80/1298/CEE della Commissione ( 3 ) , modificata dalla decisione 81/316/CEE ( 4 ) , sono state disposte misure di protezione sanitaria nei confronti del Bundesland del Tirolo ;

WHEREAS THE RESPONSIBLE VETERINARY AUTHORITIES OF AUSTRIA HAVE CONFIRMED THAT AUSTRIA HAS FOR AT LEAST 12 MONTHS BEEN FREE FROM RINDERPEST , EXOTIC FOOT-AND-MOUTH DISEASE , AFRICAN SWINE FEVER , SWINE VESICULAR DISEASE AND CONTAGIOUS PORCINE PARALYSIS ( TESCHEN DISEASE ) , WITH THE EXCEPTION OF THE IMST , INNSBRUCK ( STADT ) , INNSBRUCK-LAND , KITZBUEHEL , KUFSTEIN , LANDECK , REUTTE AND SCHWAZ DISTRICTS ( BEZIRK ) OF BUNDESLAND TYROL AND THAT NO VACCINATIONS HAVE BEEN CARRIED OUT AGAINST THOSE DISEASES DURING THAT TIME EXCEPT IN THE DISTRICTS MENTIONED ABOVE IN RESPECT OF CONTAGIOUS PORCINE PARALYSIS ( TESCHEN DISEASE ) ;
considerando che le competenti autorità veterinarie austriache hanno confermato che l ' Austria è stata per almeno gli ultimi dodici mesi indenne da peste bovina , afta epizootica a virus esotico , peste suina africana , malattia vescicolare dei suini e paralisi contagiosa dei suini ( malattia di Teschen ) , ad eccezione dei distretti di Imst ( città ) , Innsbruck ( campagna ) , Kitzbuehel , Kufstein , Landeck , Reutte e Schwaz ( Bundesland del Tirolo ) , e che durante tale periodo non sono state praticate vaccinazioni , salvo quella contro la paralisi contagiosa dei suini ( malattia di Teschen ) nei distretti sopra menzionati ;
