64 To justify and strengthen those doubts, I think it is advisable to point out that the principle of the obligation on courts of last instance to refer questions for a preliminary ruling is not the outcome of an extempore decision by the Court but is set out directly in precise and formal terms in the Treaty and is thus, by its aims and implications, one of the fundamental and essential principles, I would say almost a structural principle, of the Community legal system.

För att förklara dessa betänkligheter, vilka därigenom ytterligare förstärks, anser jag det lämpligt att erinra om att principen med obligatorisk begäran om förhandsavgörande för domstolar som dömer i sista instans inte har uppkommit genom ett plötsligt val av domstolen, utan har en precis och formell grund direkt i fördraget och således, på grund av sina ändamål och sina följder, utgör en av de grundläggande och mer utmärkande principerna, jag skulle nästan vilja säga en strukturell princip, i gemenskapens rättsordning.EurLex-2 EurLex-2
