The applicant takes the view, in essence, that there is, as the Opposition Division found, a visual, aural and conceptual similarity between the signs ‘Metromeet’ and ‘meeting metro’, as they both include the terms ‘metro’ and ‘meet’, the suffix ‘ing’ which appears in the element ‘meeting’ of the earlier word mark merely constituting the gerund of ‘meet’, which is not such as to give rise to any visual, aural or conceptual difference between those signs.
Sökanden anser att det finns – såsom invändningsenheten konstaterade – visuella, fonetiska och begreppsmässiga likheter mellan kännetecknen Metromeet och meeting metro, eftersom de båda innehåller beståndsdelarna metro och meet.
