41 Kolmanneksi Viron hallitus väittää, että direktiivin 2002/83 41 artikla, jossa säädetään, että vakuutusyrityksen, joka aikoo ensimmäisen kerran harjoittaa liiketoimintaa yhdessä tai useammassa jäsenvaltiossa palvelujen tarjoamisen vapauden perusteella, on ilmoitettava asiasta ennalta kotijäsenvaltion valvontaviranomaisille ja esitettävä niiden riskien tai sitoumusten laatu, joita se aikoo kattaa, on esteenä ilmaisun ”sitoumusjäsenvaltio” niin sanotulle dynaamiselle tulkinnalle.
