Onko yhteisestä arvonlisäverojärjestelmästä 28.11.2006 annetun neuvoston direktiivin 2006/112/EY (1) 168 artiklaa ja muita merkityksellisiä säännöksiä ja kyseiseen direktiiviin perustuvaa verotuksen neutraalisuuden periaatetta sekä unionin tuomioistuimen direktiivin tulkinnasta antamaa oikeuskäytäntöä tulkittava siten, että ostoihin sisältyvän arvonlisäveron vähentäminen ei ole sallittua elinkeinonharjoittajille, jotka käännetyn veronmaksuvelvollisuuden järjestelmässä laativat toteuttamastaan tavaroiden hankinnasta tositteen (laskun), johon sisällytetään fiktiivinen tavaroiden luovuttaja, kun on riidatonta, että hankinnan on todellisuudessa toteuttanut kyseinen elinkeinonharjoittaja, joka on sisällyttänyt ostetut materiaalit liike- tai elinkeinotoimintaansa?
