Het moge duidelijk zijn dat het risico van een dergelijke handelwijze van de staat groter is bij de eerste omzetting van de richtlijn, wanneer een duidelijk onderscheid tussen voorschriften waarbij de communautaire verplichtingen worden omgezet en voorschriften die een ander doel nastreven, binnen dezelfde handeling lastig te maken is en dus de verleiding groter is om de tweede categorie voorschriften met behulp van de eerste categorie te „camoufleren”.
