The Commission has no obligation therefore to demonstrate that trade has actually been so affected (Ferriere Nord v Commission, paragraphs 19 and 20), which, moreover, is difficult to prove to a sufficient legal standard in most cases, but it is required to establish that the agreement is capable of having that effect (Case 19/77 Miller v Commission [1978] ECR 131, paragraph 15; and Ferriere Nord v Commission, paragraph 19).
