If the legislature having primary substantive competence continues to be the national one, the European Union could, where appropriate, derive from that requirement, by contrary inference, only a right for individuals to whom the Member States grant patents for medicinal products, provided that those Member States have not opted to exclude the ‘patentability’ of some inventions for reasons of ordre public, morality, the protection of life, health or the environment (Article 27(2)).
