12 The Cooperation Agreement between the European Economic Community, of the one part, and the countries parties to the Charter of the Cooperation Council for the Arab States of the Gulf (the State of the United Arab Emirates, the State of Bahrain, the Kingdom of Saudi Arabia, the Sultanate of Oman, the State of Qatar and the State of Kuwait), of the other part, approved on behalf of the Community by Council Decision 89/147/EEC of 20 February 1989 (OJ 1989 L 54, p. 1, hereinafter `the Cooperation Agreement') provides in Article 11:
12 Euroopan talousyhteisön sekä Persianlahden arabimaiden yhteistyöneuvoston peruskirjan osapuolten (Yhdistyneet arabiemiirikunnat, Bahrainin valtio, Saudi-Arabian kuningaskunta, Omanin sulttaanikunta, Qatarin valtio ja Kuwaitin valtio) välisen yhteistyösopimuksen (jäljempänä yhteistyösopimus), joka yhteisön puolesta hyväksyttiin 20.2.1989 tehdyllä neuvoston päätöksellä 89/147/ETY (EYVL L 54, s. 1), 11 artiklassa määrätään seuraavaa:

Whereas the conclusion by the European Economic Community of the Cooperation Agreement between the European Economic Community and the countries parties to the Charter of the Cooperation Council for the Arab States of the Gulf (the State of the United Arab Emirates, the State of Bahrain, the Kingdom of Saudi Arabia, the Sultanate of Oman, the State of Qatar and the State of Kuwait) appears necessary for the attainment of the ends of the Community in the sphere of external economic relations; whereas it appears that certain measures of economic cooperation provided for by the Agreement exceed the powers provided for in the Treaty, and in particular those specified in the field of the common commercial policy,
yhteisön tavoitteiden saavuttamiseksi taloudellisten ulkosuhteiden alalla yhteisön olisi tehtävä Euroopan talousyhteisön sekä Persianlahden arabimaiden yhteistyöneuvoston peruskirjan osapuolten (Yhdistyneet arabiemiirikunnat, Bahrainin valtio, Saudi-Arabian kuningaskunta, Omanin sulttaanikunta, Qatarin valtio ja Kuwaitin valtio) välinen yhteistyösopimus; vaikuttaa siltä, että tietyt sopimuksessa määrätyt taloudellisen yhteistyön toimet ylittävät perustamissopimuksessa määrätyt valtuudet, erityisesti yhteisen kauppapolitiikan alalla,

11 DAT-SCHAUB claimed before the national court that, under the Cooperation Agreement between the European Economic Community, of the one part, and the countries parties to the Charter of the Cooperation Council for the Arab States of the Gulf (the State of the United Arab Emirates, the State of Bahrain, the Kingdom of Saudi Arabia, the Sultanate of Oman, the State of Qatar and the State of Kuwait) of the other part, approved by Council Decision 89/147/EEC of 20 February 1989, (2) even those products resulting from processing which were released for consumption in GCC countries other than the United Arab Emirates met the condition contained in the second subparagraph of Article 17(2).

Ha. whereas the day after the adoption of Parliament’s most recent resolution on Bahrain, in February 2016, the Ministry of Foreign Affairs of the Kingdom of Bahrain stated that the text adopted did not reflect the position of those political forces having real influence, or that of the European Union;
