55 It must therefore be held that suspension, under Article 10(1)(a) of Regulation No 574/72, of the right to family benefits due under the legislation of a Member State according to which the acquisition of the right to those benefits is not subject to conditions of insurance, employment or self-employment, such as the right under Paragraph 62 of the EStG, does not take place if the benefits were not paid in the other Member State concerned, on the ground that not all the conditions required by the legislation of that Member State for those benefits to be actually drawn were met, including the condition that a prior application must have been made (see, by analogy, Ragazzoni, paragraph 12; Salzano, paragraph 11; Ferraioli, paragraph 15; and Kracht, paragraph 11).

17 – I would observe that, in paragraph 54 of the judgment in Schwemmer, EU:C:2010:605, the Court pointed out that, in the judgments in Ragazzoni, EU:C:1978:88, Salzano, EU:C:1984:343, Ferraioli, EU:C:1986:168, and Kracht, EU:C:1990:279, the reasons for the absence of a prior application were not relevant to the answers given by the Court in the proceedings concerned.
17 – Ik merk op dat het Hof er in punt 54 van het arrest Schwemmer (EU:C:2010:605) op heeft gewezen dat in de arresten Ragazzoni (EU:C:1978:88), Salzano (EU:C:1984:343), Ferraioli (EU:C:1986:168) en Kracht (EU:C:1990:279) het ontbreken van een voorafgaande aanvraag geen gevolgen heeft gehad voor de antwoorden van het Hof in deze zaken.

11 In its judgments in Case 191/83 Salzano v Bundesanstalt fuer Arbeit [1984] ECR 3741 and in Case 153/84 Ferraioli v Deutsche Bundespost [1986] ECR 1401, the Court ruled that there is no suspension of the entitlement to family allowances payable in the country of employment of one of the parents when the other parent resides with the children in another Member State and pursues there a professional or trade activity but does not receive family allowances for the children on the ground that not all the conditions laid down in the legislation of that Member State for the actual receipt of such allowances, including the condition that they must first be applied for, are satisfied .

I can see only one difference between this situation and that which came before the Court in Salzano and Ferraioli, namely the fact that in those cases an application had never been made in the Member State in which the members of the family resided, whereas in this case the allowances were initially applied for in that Member State, but subsequently ceased to be applied for .

By inserting paragraph 2 into Article 76 of Regulation No 1408/71, the EU legislature intended to respond to the previous case-law of the Court of Justice (judgments in Salzano, C‐191/83, EU:C:1984:343; Ferraioli, C‐153/84, EU:C:1986:168; and Kracht, C‐117/89, EU:C:1990:279), according to which, if an application for benefits has not been made in the Member State of residence of the members of a migrant worker’s family, the entitlement to family benefits in that worker’s Member State of employment is not to be suspended.

In paragraph 14 of the Ferraioli judgment, as in paragraphs 7 to 10 in the Salzano judgment, the Court made it clear, moreover, that the "conditions laid down ... for the actual receipt of such allowances" are not only those of substance but also those of form, including the condition that a prior application has been made .

However - and the Court' s case-law assists us here - this can be so only under all the conditions defined by the Court : the family benefits must actually have been paid in the Member State of residence and the mere possibility of obtaining them is not sufficient ( see, in particular, the judgments in Ferraioli and Salzano ).

In that regard, it should be noted that, in Salzano, (19)Ferraioli (20) and Kracht, (21) the Court has already had the opportunity to consider the converse case, that is to say, the question whether allowances due in the State of employment pursuant to Article 73 of Regulation No 1408/71 are to be suspended in a situation where corresponding allowances payable in the State of residence have not been applied for and, consequently, have not actually been paid.
