27 In the light of the judgment of 19 September 2013 in Brey (C‐140/12, EU:C:2013:565), the Commission decided to confine its action to child benefit and child tax credit (‘the social benefits at issue’), to the exclusion of the ‘special non-contributory cash benefits’ that were also the subject of the reasoned opinion and which, in accordance with that judgment of the Court, can be classified as ‘social assistance’ within the meaning of Article 7(1)(b) of Directive 2004/38.
27 Gelet op het arrest van 19 september 2013, Brey (C‐140/12, EU:C:2013:565), heeft de Commissie besloten haar beroep te beperken tot de kinderbijslag en de „child tax credit” (hierna samen: „betrokken sociale prestaties”), onder uitsluiting van de „niet op premie- of bijdragebetaling berustende bijzondere uitkeringen”, waarop het met redenen omklede advies eveneens betrekking had en die, overeenkomstig dat arrest van het Hof kunnen worden aangemerkt als „bijstand” in die zin van artikel 7, lid 1, onder b), van richtlijn 2004/38.EurLex-2 EurLex-2
