At this juncture, the Landgericht Regensburg obtained an expert opinion from the Max-Planck-Institut für ausländisches und internacionales Strafrecht (Institute for Foreign and International Criminal Law), according to which even though, owing to the specific features of French law, it could not be directly enforced, the judgment given in absentia had the status of a final judicial decision in formal and substantive terms, resulting in further criminal proceedings for the same acts being barred.
