As the General Court found, in paragraph 92 of the judgement in IPK-München v Commission, paragraph 23 above, if the Commission had considered, after having adopted the refusal decision of 3 August 1994, that the new evidence on which it relied was enough to conclude that there was an unlawful collusion between Mr Tzoanos, 01‐Pliroforiki and IPK, which had invalidated the grant procedure, it could, instead of putting forward during the first legal proceedings a ground not mentioned in that decision, have revoked the decision and adopted a new decision, containing not only a refusal to pay the second instalment of the financial assistance, but also an order for repayment of the instalment already paid.
Såsom förstainstansrätten angav i punkt 92 i domen i det ovan i punkt 23 nämnda målet IPK-München mot kommissionen, hade kommissionen, om den efter det att den fattat beslutet om avslag av den 3 augusti 1994 ansåg att de nya indicier som den åberopat var tillräckliga för att dra slutsatsen att det förelåg en olaglig samverkan mellan Tzoanos, 01-Pliroforiki och IPK, som innebar att förfarandet för tilldelning av stöd blev ogiltigt – i stället för att under det första förfarandet åberopa skäl som inte anges i nämnda beslut – kunnat återkalla stödet och fatta ett nytt beslut, inte bara om att inte betala den andra delen av stödet utan även om att begära att den redan utbetalade delen skulle betalas tillbaka.EurLex-2 EurLex-2
