29 Kyseisestä oikeuskäytännöstä seuraa yhtäältä, että asetuksen N:o 44/2001 5 artiklan 1 alakohdassa tarkoitettua käsitettä ”sopimusta koskeva asia” on tulkittava itsenäisesti, jotta sen yhtenäinen soveltaminen kaikissa jäsenvaltioissa taattaisiin, ja toisaalta, että jotta kyseessä olisi sopimusta koskeva asia, kanteella on riitautettava oikeudellinen velvoite, johon henkilö on vapaaehtoisesti antanut suostumuksensa suhteessa toiseen osapuoleen (ks. vastaavasti tuomio 14.3.2013, Česká spořitelna, C-419/11, EU:C:2013:165, 45–47 kohta ja tuomio 28.1.2015, Kolassa, C-375/13, EU:C:2015:37, 37 ja 39 kohta).
