Tämän arvioinnin tekemiseksi ennakkoratkaisua pyytänyt tuomioistuin pohtii direktiivin 95/46 johdanto-osan 12 perustelukappaleessa mainittujen seikkojen vaikutusta – vaikka kerätyt tiedot vaikuttavat laajemmilta kuin perinteisesti kerätyt tiedot osoitteiston pitämiseksi muun muassa siksi, että ne voivat olla arkaluonteisia ja niitä kerätään jäsenille vieraista ihmisistä –, kun otetaan seuraavaksi huomioon luonnollisten henkilöiden suojelusta henkilötietojen käsittelyssä sekä näiden tietojen vapaasta liikkuvuudesta ja direktiivin 95/46 kumoamisesta 27.4.2016 annetun Euroopan parlamentin ja neuvoston asetuksen (EU) 2016/679(5) johdanto-osan 18 perustelukappaleella esitetty täsmennys ja lopuksi yhdyskunnan rooli.
For the purpose of that assessment, the referring court raises the issue of the effect of the guidance contained in recital 12 of Directive 95/46, whereas the data collected would seem to go further than the data traditionally collected for the purpose of keeping an address book, particularly in that it may be sensitive and be collected in connection with persons unknown to the members, having regard, next, to the clarification provided by recital 18 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 (5) and, finally, to the role played by the religious community.eurlex-diff-2018-06-20 eurlex-diff-2018-06-20
