Le tribunal de commerce de Bruxelles nous pose deux questions qui se situent dans le cadre d' un litige opposant l' Office belge de l' économie et de l' agriculture ( ci-après "OBEA ") à la société anonyme Établissements Soules & Cie à propos de la non-exécution d' un contrat d' adjudication pour la fourniture de 550 tonnes de farine de blé à titre d' aide alimentaire en faveur du Soudan .
The Tribunal de commerce, Brussels, has referred to the Court two questions which have arisen in proceedings between l' Office belge de l' économie et de l' agriculture ( Belgian Office for the Economy and Agriculture, hereinafter referred to as the "OBEA ") and Établissements Soules & Cie SA ( hereinafter referred to as "Soules ") concerning the failure to perform a contract awarded by the tendering procedure for the supply of 550 tonnes of wheat flour as food aid for Sudan .

2 THAT QUESTION WAS RAISED IN CONNECTION WITH A DISPUTE BETWEEN NICOLAS CORMAN ET FILS SA ( HEREINAFTER REFERRED TO AS ' CORMAN ' ) AND THE OFFICE BELGE DE L ' ECONOMIE ET DE L ' AGRICULTURE ( BELGIAN TRADE AND AGRICULTURE BOARD , HEREINAFTER REFERRED TO AS ' THE BOARD ' ), THE BELGIAN INTERVENTION AGENCY , CONCERNING THE RELEASE OF CERTAIN SUMS LODGED AS SECURITIES FOR THE PROCESSING AND PACKAGING OF INTERVENTION BUTTER , IN ACCORDANCE WITH THE PROVISIONS OF REGULATION NO 649/78 .
