Une dérogation à l'article 102 du Règlement fondée sur une convention fiscale est accordée si un employé qui réside aux États-Unis répond aux critères applicables suivants : 1) sa rémunération totale pour l'année civile où l'emploi a été exercé au Canada ne dépasse pas 10 000 $CAN; OU 2) il est présent au Canada pendant une ou plusieurs périodes n'excédant pas au total 183 jours dans l'année civile; ET La charge de sa rémunération n'est pas assumée par : a) un employeur qui est un résident du Canada, OU b) un établissement stable ou une base fixe que l'employeur possède au Canada.
A Regulation 102 treaty-based waiver will be granted if a US resident employee meets the following criteria: 1) The total remuneration does not exceed CAN$10,000 in the calendar year in which the employment is exercised in Canada; OR 2) The employee is not present in Canada for a period or periods exceeding 183 days in the calendar year; AND The remuneration is not borne by: a) an employer who is a resident of Canada, OR b) a permanent establishment or fixed base which the employer has in Canada.
