Le gouvernement français trouve confirmation du rôle essentiel de la traçabilité en tant qu'instrument de gestion des risques dans l'arrêt Royaume-Uni/Commission, précité, dans lequel la Cour a jugé que l'extension de l'interdiction d'exportation des bovins britanniques aux animaux de moins de six mois apparaissait justifiée, même eu égard au principe de proportionnalité, en raison du fait qu'aux «incertitudes scientifiques quant aux modes de transmission de l'ESB [...] [s'ajoutait] l'absence de marquage des animaux et de contrôle de leurs mouvements [avec le] résultat qu'il n'[était] pas possible d'avoir la certitude qu'un veau [fût] issu d'une vache totalement exempte d'ESB ou, même si tel était le cas, qu'il [fût] lui-même totalement exempt de la maladie» .
