85 E tekintetben az Elsőfokú Bíróság emlékeztet arra, hogy a jóhiszeműség elve a nemzetközi szokásjog szabálya, amelynek létezését a Nemzetek Szövetsége keretében felállított Állandó Nemzetközi Bíróság (lásd az Intérêts allemands en Haute-Silésie polonaise [Német érdekek a lengyel Felső-Sziléziában] ügyben 1926. május 25‐én hozott ítéletet, CPJI, A. sorozat, 7. sz., 30. és 39. o.), majd a Nemzetközi Bíróság is elismerte, ezért ez az elv kötelező a Közösségre, valamint a többi részes félre nézve.
85 In that regard, the Court would point out that the principle of good faith is a rule of customary international law, the existence of which has been recognised by the Permanent Court of International Justice established by the League of Nations (see the judgment of 25 May 1926, German interests in Polish Upper Silesia, CPJI, Series A, No 7, pp. 30 and 39), and subsequently by the International Court of Justice and which, consequently, is binding in this case on the Community and on the other participating partners.EurLex-2 EurLex-2
