58 Daar waar in een situatie zoals die in het hoofdgeding, de winst van de vennootschap die haar feitelijke bestuurszetel heeft verplaatst, pas na genoemde zetelverplaatsing wordt belast in de lidstaat van ontvangst, overeenkomstig het fiscale territorialiteitsbeginsel, verbonden met een temporele component, staat het, gelet op eerdergenoemd verband tussen de activa van een vennootschap en haar belastbare winst – en derhalve om redenen die verband houden met de symmetrie tussen het recht om belasting over winst te heffen en de mogelijkheid om verlies in aftrek te brengen –, tevens aan deze laatste lidstaat om in zijn belastingregime rekening te houden met fluctuaties in de waarde van de activa van de betrokken vennootschap die zijn opgetreden na de datum waarop de lidstaat van oorsprong elke fiscale aanknoping met genoemde vennootschap heeft verloren.
58 Since, in a situation such as that at issue in the main proceedings, the profits of a company which transfers its place of effective management are, after the transfer, taxed exclusively in the host Member State, in accordance with the principle of fiscal territoriality linked to a temporal component, it is also for that Member State, in view of the above-mentioned connection between a company’s assets and its taxable profits, and hence for reasons relating to the symmetry between the right to tax profits and the possibility of deducting losses, to take account in its tax system of fluctuations in the value of the assets of that company which occur after the date on which the Member State of origin loses all fiscal connection with the company.EurLex-2 EurLex-2
