Uit het dossier in de onderhavige zaak blijkt niet dat de Maltese vennootschappen met de Oostenrijkse vennootschap die hun materiële middelen ter beschikking stelt, commerciële overeenkomsten hebben gesloten uit hoofde waarvan die laatste duurzaam voor hen zou moeten optreden zoals een agentschap zou doen, volgens de criteria die het Hof in het arrest van 4 december 1986, Commissie/Duitsland(16) heeft aangegeven en die in de reeds aangehaalde arresten Winner Wetten(17) en Stoβ e.a.(18) zijn overgenomen.
In the present case, the documents in the case do not show that the Maltese companies concluded, with the Austrian company which provided them with material resources, commercial agreements which have the effect of giving that company a mandate to act permanently on their behalf in the same way as an agency, in accordance with the criteria laid down by the Court in Commission v Germany, (16) and reproduced in Winner Wetten (17) and Stoβ and Others.
