109 Hieruit volgt dat de door verzoeksters geleden schade, zo deze al vaststaat, in geen geval kan zijn veroorzaakt door de bestreden handeling, maar het resultaat is van de uitvoering van richtlijn 67/548 en, eventueel, van de wijziging van deze richtlijn wat de indeling van colofonium betreft.

In de bestreden handeling werd voorts gepreciseerd dat „colofonium een van de tien producten is die als het meest allergeen worden beschouwd”.

Zoals verweerster terecht stelt, blijkt overigens uit punt 99 van het verzoekschrift dat verzoeksters zelf in wezen van mening zijn dat de gestelde schade zijn oorsprong heeft in de „onwettige indeling”, dat wil zeggen in de handeling waarbij colofonium is ingedeeld als gevaarlijke stof.
Furthermore, as the defendant rightly submits, it is clear from paragraph 99 of the application that the applicants themselves essentially consider that the source of the alleged damage is ‘the unlawful classification’, that is to say the measure classifying rosin as a dangerous substance.
