För det andra vad gäller beviskravet anser jag att syftet med den tolkning som domstolen gjorde i domarna Simon, Evers & Co. och APEX vid bristande samarbete, nämligen att inte äventyra unionens handelspolitiska skyddsåtgärders effektivitet(48) även gäller i ett sådant fall som det förevarande där de företag som inte samarbetat i undersökningen står för en övervägande andel av importen av den berörda varan till unionen.(
Secondly, in so far as concerns the standard of proof, I think that the reason for the interpretation adopted by the Court in its judgments in Simon, Evers & Co. and APEX in cases in which there was a total failure to cooperate, that is to say, the need to ensure that the effectiveness of EU trade-defence measures is not compromised, (48) is equally valid in a case, such as the present, in which the undertakings that failed to cooperate in the investigation account for the majority of the imports of the product in question into the Union.EurLex-2 EurLex-2
