33 När en europeisk arresteringsorder har utfärdats med syftet att en annan medlemsstat ska gripa och överlämna en eftersökt person för lagföring, ska denna person i det första skedet av förfarandet redan ha kommit i åtnjutande av processrättsliga skyddsregler och grundläggande rättigheter, vilka det ankommer på den rättsliga myndigheten i den utfärdande medlemsstaten att säkerställa skyddet av enligt tillämplig nationell rätt, bland annat i syfte att utfärda en nationell arresteringsorder (dom av den 27 maj 2019, OG och PI (åklagarmyndigheterna i Lübeck och Zwickau), C‐508/18 och C‐82/19 PPU, EU:C:2019:456, punkt 66).
33 In that context, where a European arrest warrant is issued with a view to the arrest and surrender by another Member State of a requested person for the purposes of conducting a criminal prosecution, that person must have already had the benefit, at the first stage of the proceedings, of procedural safeguards and fundamental rights, the protection of which it is the task of the judicial authorities of the issuing Member State to ensure, in accordance with the applicable provisions of national law, for the purpose, inter alia, of adopting a national arrest warrant (see, to that effect, judgment of 27 May 2019, OG and PI (Public Prosecutor’s Offices of Lübeck and Zwickau), C‐508/18 and C‐82/19 PPU, EU:C:2019:456, paragraph 66).Eurlex2019 Eurlex2019
