It should be mentioned that the Law does not determine precisely whether relative or absolute nullity is involved, and even the Belgian courts do not concur in this matter; see, for example, the judgment of the Hof van beroep te Antwerpen (Court of Appeal, Antwerp) of 31 October 2005 (Rechtskundig Weekblad 2007-2008, No 22, 26.1.2008), in which the court held that absolute nullity was involved, and the judgment of the Hof van beroep te Gent (Court of Appeal, Ghent) of 21 February 2007 (Jaarboek Handelspraktijken & Mededinging 2007, p. 369), in which the court held that relative nullity was involved.
