In short, in order to settle the dispute, the Conseil d’État does not need to know whether the combined effect of Directive 70/458, which does not apply to shallots, and Directive 92/33, which does, is to prohibit the inclusion of seed varieties of that kind of liliaceous plant in the common catalogue, without guaranteeing their freedom of movement, since the Order on which it has to give a ruling does not govern propagation material but specimens which have been reproduced for sale to the consumer.
