52 In light of the above, the answer to the first question referred for a preliminary ruling must be that Article 201(1)(a), in conjunction with Article 201(2), of the Customs Code, must be construed as meaning that a customs debt on importation is not to be regarded as having been incurred if, for reasons attributable to the declarant - the goods which had the status of goods in temporary storage having been removed without the permission of the customs office - the suspensory condition concerning examination of those goods has not been fulfilled, having been rendered purposeless, where that condition accompanied the acceptance by the competent customs office of a declaration for the release of non-Community goods into free circulation that satisfied the requirements of Article 62 of the Customs Code and its acceptance was evidenced by the attachment of a customs registration stamp.
