It must be added that, should practices such as those to which the Commission refers be proven, it would be for the competent national authorities, who have the task of ensuring the correct and straightforward application of the reduced rate they have chosen and the prevention of any possible evasion, avoidance or abuse (see paragraph 30 of this judgment), to examine whether those practices may be considered to be an abusive practice by referring, if necessary, to the criteria developed to this effect by the Court’s case-law (see, inter alia, Case C-255/02 Halifax and Others [2006] ECR I-1609, paragraphs 74 to 76).
För det fall en sådan tillämpning som kommissionen har hänvisat till skulle kunna fastställas, ska det tilläggas att det ankommer på behöriga nationella myndigheter – vilka ska säkerställa en enkel och korrekt tillämpning av den reducerade skattesats som myndigheten har valt och se till att skatteundandragande, skatteflykt och allt eventuellt missbruk förhindras (se punkt 30 i denna dom) – att pröva om sådan tillämpning kan omfattas av begreppet missbruk, genom att i förekommande fall grunda sig på de kriterier som för detta ändamål har utvecklats i domstolens praxis (se bland annat dom av den 21 februari 2006 i mål C‐255/02, Halifax m.fl., REG 2002, s.
