52 In view of all the foregoing considerations, the answer to the first three questions is that the term ‘judicial authority’, referred to in Article 6(1) of the Framework Decision, is an autonomous concept of EU law and that that provision must be interpreted as meaning that a police service, such as the Swedish police board, is not covered by the term ‘issuing judicial authority’, within the meaning of the same Article 6(1), meaning that the European arrest warrant issued by that police service with a view to executing a judgment imposing a custodial sentence cannot be regarded as a ‘judicial decision’, within the meaning of Article 1(1) of the Framework Decision.
52 Mot bakgrund av ovanstående ska den första, den andra och den tredje frågan besvaras enligt följande. Begreppet rättslig myndighet i artikel 6.1 i rambeslutet är ett självständigt unionsrättsligt begrepp, och denna artikel 6.1 ska tolkas så, att en polismyndighet, såsom den svenska Rikspolisstyrelsen, inte omfattas av begreppet utfärdande rättslig myndighet enligt denna bestämmelse, vilket innebär att den europeiska arresteringsorder som polismyndigheten har utfärdat för verkställighet av en frihetsberövande påföljd inte kan anses utgöra ett rättsligt avgörande enligt artikel 1.1 i rambeslutet.EurLex-2 EurLex-2
