In a judgment of the Superior Administrative Court of North-Rhine Westphalia in Germany, Opalescence products were found to fall within the definition of ‘medical device’ in Directive 93/42/EEC(1), and properly marked with the required CE marking as Class IIa medical devices following certification by a medical devices notified body.
