In the light of all of the foregoing considerations, I propose that the Court should annul the judgment under appeal in so far as the General Court declared that it is solely for the Commission, in the exercise of its power to impose fines, to determine the respective shares of the fine to be paid by the different companies held jointly and severally liable, and that this task cannot be left to the national courts, and in so far as, relying on that principle, as well as on the rule that liability is to be attributed in equal measure in the absence of any indication in that regard in the decision, the General Court went on to determine, in the exercise of its unlimited jurisdiction, the shares to be paid by each of the applicant companies at first instance.
