Met hun hogere voorzieningen verzoeken deze twee ondernemingen om vernietiging van het arrest van het Gerecht van de Europese Unie van 29 april 2015, Changshu City Standard Parts Factory en Ningbo Jinding Fastener/Raad(2) (hierna: „bestreden arrest”), waarbij het Gerecht hun beroepen tot nietigverklaring van uitvoeringsverordening (EU) nr. 924/2012 van de Raad van 4 oktober 2012(3) (hierna: „litigieuze verordening”) heeft verworpen.
By their appeals, both companies ask the Court of Justice to set aside the judgment of the General Court of the European Union of 29 April 2015, Changshu City Standard Parts Factory and Ningbo Jinding Fastener v Council (2) (‘the judgment under appeal’), by which the latter dismissed their action for annulment of Council Implementing Regulation (EU) No 924/2012 of 4 October 2012 (3) (‘the regulation at issue’).

40 De door het Gerecht in dat arrest gekozen oplossing heeft volgens rekwirante per definitie tot gevolg dat producenten-exporteurs van landen zonder markteconomie die niet voldoen aan de voorwaarden om in aanmerking te komen voor BMO, niet erom kunnen verzoeken dat de normale waarde wegens dergelijke verschillen wordt aangepast overeenkomstig artikel 2, lid 7, onder a), van de basisverordening, terwijl, volgens de arresten van 10 oktober 2012, Shanghai Biaowu High-Tensile Fastener en Shanghai Prime Machinery/Raad (T‐170/09, niet gepubliceerd, EU:T:2012:531, punt 123), en 29 april 2015, Changshu City Standard Parts Factory en Ningbo Jinding Fastener/Raad (T‐558/12 en T‐559/12, niet gepubliceerd, EU:T:2015:237, punt 110), deze producenten-exporteurs evenmin op grond van artikel 2, lid 10, van die verordening om een correctie wegens deze verschillen kunnen verzoeken.
40 The appellant submits that the solution adopted by the General Court in that judgment results in the exclusion, in principle, of the possibility for exporting producers of non-market economy countries that do not qualify for MET of requesting adjustments of the normal value on account of such differences under Article 2(7)(a) of the basic regulation, even though — pursuant to the judgments of 10 October 2012, Shanghai Biaowu High-Tensile Fastener and Shanghai Prime Machinery v Council (T‐170/09, not published, EU:T:2012:531, paragraph 123), and of 29 April 2015, Changshu City Standard Parts Factory and Ningbo Jinding Fastener v Council (T‐558/12 and T‐559/12, not published, EU:T:2015:237, paragraph 110) — those exporting producers are already denied the possibility of requesting adjustments on account of those differences on the basis of Article 2(10) of the basic regulation.
