Mot bakgrund av genomgången inledningsvis angående skyldigheten för nationella domstolar att begära ett förhandsavgörande skall jag för att kunna besvara den första tolkningsfrågan inledningsvis undersöka huruvida en nationell domstol får fatta ett beslut som avviker från ett bindande besked som har utfärdats till tredje man av en tullmyndighet i en annan medlemsstat avseende en likartad vara utan att föra frågan vidare till domstolen, eller om det här föreligger en skyldighet att begära ett förhandsavgörande – även för en nationell domstol som inte är sista instans – i den mening som avses i domen i målet Foto-Frost.
