23 För det fall artikel 16 e i direktiv 2011/83 ska tolkas på så sätt att varor som kan komma i direkt kontakt med människokroppen vid normal användning, såsom madrasser, utgör sådana varor som av hälsoskydds- eller hygienskäl inte lämpligen kan returneras enligt denna bestämmelse, även om näringsidkaren genom lämpliga rengöringsåtgärder kan återställa dem i sådant skick att de kan säljas på nytt, uppkommer, enligt den hänskjutande domstolen, frågan vilka krav förpackningen till varor av denna typ måste uppfylla och huruvida det av de konkreta omständigheterna, exempelvis genom märkningen ”försegling”, klart måste framgå att det inte endast är fråga om en transportförpackning, utan om en förslutning av varorna som gjorts av hälsoskydds- eller hygienskäl.
23 The referring court takes the view that, if Article 16(e) of Directive 2011/83 ought to be interpreted as meaning that goods which can come into direct contact with the human body, such as mattresses, when they are used as intended, even if the trader is able to render them saleable once again by using appropriate cleaning methods, are amongst the goods which cannot be returned for health protection or hygiene reasons referred to by the provision, that raises the question of which conditions the packaging of such goods must fulfil, and whether it must be clear from the specific circumstances, in particular the affixing of the word ‘sealed’ to the packaging, that it is not mere packaging for transportation purposes, but rather that the product has been sealed for health protection or hygiene reasons.Eurlex2019 Eurlex2019
