DIE IM STREIT BEFINDLICHEN TARIFE WERDEN DAHER ZU RECHT GEGENÜBER DEM TARIF AT 6 B 1 ALS " AUSNAHMETARIFE IM BINNENVERKEHR " BEZEICHNET . SIE GEWÄHREN KEINE FRACHTERMÄSSIGUNG, DIE ETWA GEGENÜBER DEN FRACHTSÄTZEN DES AUF DIE KLAEGERINNEN ANWENDBAREN DIREKTEN INTERNATIONALEN EGKS-TARIFS DISKRIMINIEREND WÄRE, DA DIESER AUF DER GRUNDLAGE EINES BINNENTARIFS MIT TATSÄCHLICH ALLGEMEINEM GELTUNGSBEREICH BERECHNET WORDEN IST .
IT IS TRUE THAT THE EFFECTS OF THE INTERVENTION OF THE HIGH AUTHORITY, TAKING INTO ACCOUNT WHAT HAS BEEN STATED ABOVE IN CONNEXION WITH THE FIRST COMPLAINT, DO NOT CORRESPOND TO THE WISHES, WHICH ARE MOREOVER UNDERSTANDABLE, OF THE APPLICANTS BUT IT MUST BE NOTED THAT THESE EFFECTS ARE CAUSED, ON THE ONE HAND, BY THE FACT THAT THE TREATY ESTABLISHING A COMMUNITY RESTRICTED TO COAL AND STEEL ONLY COVERED TRANSPORT INDIRECTLY AND TO A LIMITED EXTENT AND, ON THE OTHER HAND, BY THE FACT THAT THE NETWORK OF WATERWAYS COMPETING WITH THE RAILWAYS WAS IN THE PAST DEVELOPED MUCH MORE WITHIN THE VARIOUS COUNTRIES THAN FOR TRAFFIC WITH COUNTRIES ABROAD .

Es bestuende daher - insbesondere nach der Erhöhung der SNCF-Tarife von rund 12 % anfangs 1970 - die Gefahr, daß die SMN erneut, wie bereits vor 1969, ihre Erzbezuege umstelle. Trotz der Frachtermässigung blieben die Beförderungen für die SNCF rentabel und trügen zur Verbesserung des finanziellen Betriebsergebnisses bei.
Whereas the French Government has invoked, in support of the Tariff Agreement, the SNCF's particular interest in retaining an important source of traffic ; whereas without the traffic reduction the iron ore from the Halouze mine would not be able to compete against richer and cheaper ores carried by other means ; whereas there would then be a risk, particularly in view of the increase in railway tariffs early in 1970 by about 12 %, that SMN would, as it did before 1969, use the latter ores ; whereas, in spite of the reductions, carriage would remain profitable for the SNCF and would contribute to the improvement of its operating results;

In Anbetracht der wirtschaftlichen Lage der Montanindustrie an der Saar und der zur Zeit noch laufenden Umstrukturierungsbemühungen erscheint es angebracht, die Verringerung der prozentualen Frachtermässigungen um 50 %, wie sie in der obenerwähnten Entscheidung 82/445/EGKS festgelegt worden ist, ab 1. Januar 1984 nicht anzuwenden; die Aufhebung der Tarife zum 31. Dezember 1984 wird jedoch beibehalten.
Whereas, in view of the economic situation of the ECSC industries in the Saar and the restructuring measures that are in progress, it seems appropriate not to enforce from 1 January 1984 the reduction of 50 % in the reduction granted under these tariffs that had been fixed in the aforementioned Decision 82/445/ECSC; whereas, however, the date for abolishing these tariffs should remain 31 December 1984,
