Nor do I agree, as argued in the written observations of the Appellant, that application of the prohibition on levelling down while the Barber window is open, results, on the facts arising in the main proceedings, in conferral of an indefeasible right for men to a retirement age of 60, when women are conferred with an defeasible right only to retire at 60, under English law, so that men are afforded greater rights than those enjoyed by women.
