47 Furthermore, while, on the one hand, the applicant for a Community trade mark cannot in opposition proceedings challenge the validity of the earlier mark put forward in opposition, on the ground that its registration would be contrary to Article 7 of Regulation No 40/94 (see, to that effect, Case T-186/02 BMI Bertollo v OHIM – Diesel (DIESELIT) [2004] ECR II-1887, paragraph 71), on the other hand, where an absolute ground of refusal precludes registration of the Community trade mark applied for, OHIM has the power, in tandem with the opposition proceedings, to reopen the examination procedure in order to determine whether there may be such a ground (see, to that effect, Case T-224/01 Durferrit v OHIM – Kolene (NU-TRIDE) [2003] ECR II-1589, paragraph 73).
47 Voorts kan de aanvrager van een gemeenschapsmerk in het kader van een oppositieprocedure weliswaar de geldigheid van het aangevoerde oudere merk niet betwisten op grond dat de inschrijving ervan in strijd is met artikel 7 van verordening nr. 40/94 [zie in die zin arrest Gerecht van 30 juni 2004, BMI Bertollo/BHIM – Diesel (DIESELIT), T‐186/02, Jurispr. blz. II‐1887, punt 71], maar in het geval van een absolute weigeringsgrond die zich zou verzetten tegen de inschrijving van het aangevraagde gemeenschapsmerk kan het BHIM, naast de oppositieprocedure, de onderzoeksprocedure opnieuw openen teneinde na te gaan of een dergelijke grond bestaat [zie in die zin arrest Gerecht van 9 april 2003, Durferrit/BHIM – Kolene (NU-TRIDE), T‐224/01, Jurispr. blz.
