Moreover, the rules or principles laid down in or derived from those directives may be relied on against the Community administration if, in the exercise of its operational and institutional autonomy and within the limits of the powers conferred on it by the EC Treaty, it adopts a measure which expressly refers, for the purpose of governing the public contracts which it concludes for its own account, to certain rules or principles laid down in the directives, the effect of which is that those rules and principles are applicable in accordance with the principle patere legem quam ipse fecisti (see, to that effect, Joined Cases 87/77, 130/77, 22/83, 9/84 and 10/84 Salerno and Others v Commission and Council [1985] ECR 2523, paragraphs 52, 56 and 57, and Case C‐496/99 P Commission v CAS Succhi di Frutta [2004] ECR I‐3801, paragraphs 113 to 115).
Dessutom kan de regler och principer som uppställs i eller följer av dessa direktiv åberopas mot gemenskapsadministrationen, när den under utövandet av sitt funktionella och institutionella oberoende och inom ramen för de befogenheter som den tilldelats genom EG‐fördraget har antagit en rättsakt där det uttryckligen, i syfte att reglera de offentliga upphandlingar som den genomför för egen räkning, hänvisas till bestämda regler eller principer i direktiven, varvid dessa regler och principer blir tillämpliga i enlighet med principen att den som har stiftat en lag själv måste följa den (patere legem quam ipse fecisti) (se, för ett liknande resonemang, domstolens dom av den 11 juli 1985 i de förenade målen 87/77, 130/77, 22/83, 9/84 och 10/84, Salerno m.fl. mot kommissionen och rådet, REG 1985, s. 2523, punkterna 52, 56 och 57, samt av den 29 april 2004 i mål C‐496/99 P, kommissionen mot CAS Succhi di Frutta, REG 2004, s.
