Kun EKP päättää siis mainitun päätöksen 4 artiklan 1 kohdan nojalla evätä oikeuden tutustua tiettyyn asiakirjaan, jonka toimittamista siltä on pyydetty, sen on siis lähtökohtaisesti perusteltava syy, jonka vuoksi oikeus tutustua kyseiseen asiakirjaan saattaisi konkreettisesti ja tosiasiallisesti vahingoittaa kyseisessä säännöksessä, johon se vetoaa, säädetyllä poikkeuksella suojeltua etua (ks. edellä 53 kohdassa mainittu tuomio Thesing ja Bloomberg Finance v. EKP, EU:T:2012:635, 41 ja 42 kohta).
