Ancora, allorché la ricorrente chiede, dopo l'annullamento della sentenza di primo grado, che la Corte giudichi nel merito e annulli la decisione «Polipropilene» per motivi attinenti alla sua legittimità formale o sostanziale, l'eventuale annullamento di tale atto non ha efficacia erga omnes ma soltanto in favore della ricorrente.
Again, where the appellant seeks, in addition to the annulment of the first-instance judgment, an adjudication by the Court on the merits of the case and a declaration that the Polypropylene decision is invalid, on grounds connected with its formal or substantive legality, annulment of that act does not operate erga omnes but only in favour of the appellant.

280 The applicant' s argument to the effect that the established producers could have blocked the entry onto the market of the newcomers fails to take into account the fact that those newcomers were large undertakings which could afford to incur losses, even heavy losses, for several years in order to penetrate the polypropylene market, since they had other areas of business from which they could cover their losses.
