Zoals ik in de punten 67 tot en met 70 van deze conclusie reeds heb uiteengezet, lijkt het in het licht van het arrest Cadbury Schweppes en Cadbury Schweppes Overseas ook noodzakelijk te onderzoeken of een belemmering van de vrijheid van vestiging niet voortvloeit uit een door § 20, leden 2 en 3, AStG ingevoerd verschil in behandeling tussen een situatie als die van de vennoten van Columbus en een andere grensoverschrijdende situatie, namelijk, nauwkeuriger gezegd, wanneer gebruikmaking van de vrijheid van vestiging plaatsvindt in een lidstaat met een hogere belasting dan die welke is voorzien in het AStG.
