Ten slotte stelt het Parlement dat, mocht met de memorie van Parigi rekening worden gehouden, deze in ieder geval niet-ontvankelijk moet worden verklaard op grond van artikel 51, tweede alinea, van het Statuut-EG van het Hof van Justitie, dat bepaalt dat „[h]ogere voorziening [...] niet uitsluitend betrekking [kan] hebben op de veroordeling in of het bedrag van de proceskosten.”
