Indien de exploitant die het materiaal in de handel brengt, op basis van reeds bestaand bewijsmateriaal echter kan bewijzen dat de aanwezigheid van zeswaardig chroom in het materiaal kan worden uitgesloten omdat het op geen enkel moment tijdens het productieproces werd gebruikt of zich heeft gevormd, moet driewaardig chroom als de enige migrerende soort worden beschouwd en moet bijgevolg overeenkomstig artikel 11, lid 4, tweede alinea, van de verordening een migratielimiet van 3,6 mg/kg levensmiddel gelden.
However, if the business operator placing the material on the market can prove on the basis of pre-existing documentary evidence that the presence of hexavalent chromium in the material can be excluded because it is not used or formed during the entire production process, the migrating species should be considered trivalent chromium only and therefore a migration limit of 3,6 mg/kg food should apply in accordance with the second subparagraph of Article 11(4) of the Regulation.EuroParl2021 EuroParl2021
