118 Ten eerste aanvaardt het Gerecht in punt 33 van het bestreden arrest zonder enig onderzoek de stelling van de Commissie dat de in de richtsnoeren gestelde voorwaarde dat er voor een forfaitaire financiële correctie sprake moet zijn van een ernstige tekortkoming bij de toepassing van expliciete communautaire voorschriften, moet worden gelezen tegen de achtergrond van de voorwaarde die is opgenomen in de daaraan voorafgaande alinea van de richtsnoeren, te weten dat forfaitaire correcties moeten worden overwogen als de Commissie constateert dat controles die in een regeling expliciet zijn voorgeschreven, of die impliciet vereist zijn om een expliciet voorschrift na te leven, achterwege zijn gebleven.
118 First, in paragraph 33 of the judgment under appeal, the Court of First Instance endorsed without examination the Commission’s assertion that the condition laid down in the Guidelines that a flat-rate financial correction requires there to be a serious deficiency in the compliance with explicit Community rules should be read in the light of the condition, laid down in the preceding paragraph of the Guidelines, that flat-rate corrections should be considered when the Commission finds a failure adequately to effect any control which is explicitly required by a regulation or implicitly required in order to respect an explicit rule.EurLex-2 EurLex-2
